What Does Workers' Comp Cover

Workers' compensation is an insurance program issued by the state. It serves workers' who suffered from injuries, illnesses, or disabilities while on the job.

As long as your injury or illness is work-related, your medical expenses can be covered by the workers' compensation insurance. This includes emergency room visits, surgery costs, and medications. If you need ongoing treatment, this too can be covered by the program.

Eligibility For Workers' Compensation

Although the rules for the workers' compensation program will depend on the state, there are four basic requirements necessary for you to benefit from the program.

You Must Be An Employee

To benefit from the workers' compensation, you must be an employee of your company and not an independent contractor.

Your Employer Must Be Covered By The Workers' Compensation Program

Depending on the state, an employer would be required to have workers' compensation insurance depending on the number of employees, the type of business, or what kind of work the employees are doing.

Injury Or Illness Sustained Must Be Work-Related

An injury or illness will be considered work-related if it occurred while working. Examples of this would be getting hit by falling objects on a construction site or getting in an accident while driving a company vehicle for work. This does not include injuries sustained when the employee is on a lunch break, fooling around, intentionally trying to hurt themselves, or when committing a severe crime.

Reporting And Filing Should Be Within The Deadline

In most states, you only have 30 days from when the injury or illness occurred to report and file a claim. Waiting too long to file a claim could make you lose your rights to receive workers' compensation benefits.
